Facts

Appellants were convicted on a charge of murder and were sentenced to death. They against their conviction in the Court of Appeal contending that their trial was a nullity because no plea was taken by any of the appellants at the trial.

The Court of Appeal ordered a retrial but omitted to quash the conviction.

An appeal to the Supreme Court was lodged.
